Definitions
A. "You" and "your" and “Buyer” refer to
the person who buys or has agreed to buy goods from us.
B. "We", "our" and "us" or “seller”
refer to Portobello Home and Garden, our
employees.
These Terms and Conditions NONE shall in full or
part override or affect your statutory rights.
Agreement Terms
The terms of this agreement cannot be changed without the
agreement of the other. If you require any changes, please make sure that you
ask for these to be put in writing(email or letter). This is to ensure a
limitation on problems that may arise surrounding what you have agreed and what
is expected of us.
Order Dispatch Timing
Although we cannot specify the exact date of delivery at the
time that you place your order,We aim to dispatch all items within 10 business
days and suggest a further 5 business days for delivery(to mainland UK)
A member of the sales team soon after the confirmation of your
order to give you an expected delivery date or an approximate waiting time. If
events or circumstances outside our control (weather, industrial action etc) affect
the original estimated delivery date beyond a reasonable time, we will inform
you.
Delivery Terms
We endeavour to
reasonably meet the date given
for delivery. In the event of our failure to deliver due to unforeseen
circumstances beyond our control, we will contact you immediately when we
become aware of the problem and arrange an alternative delivery date, within
ten working days of the original date.
Please check the packages are intact BEFORE accepting
delivery – any visible external damage should not be signed for,this
is also relevant for palletised deliveries. Once signed for, Portobello Home
And Garden does not accept any liability
for goods damaged in transit.
Should you permit the driver permission to enter your property
with an item of furniture, this is under your permission and we will not be
made responsible for any accidental damage made to the goods or inside the
property.
You should inform us
of any faults that you have found with the item or its packaging as soon as you
take delivery and you may be asked to provide photographic evidence of the
fault(s) before we re-deliver a new item.
Please tell us as soon as you can if there are likely to be
any problems that may affect your delivery. We will not deliver any goods if
access is denied or is not possible in a safe manner.
Where a failed
delivery results from circumstances within your control you (the buyer) will e
responsible for a charge for
redelivering the goods. In any event, if delivery is not possible, we will
arrange with you, to make a delivery to another address and/or on another date.
In most cases the delivery driver will not be able to offer
a revised delivery time or date on site because of pre-booking lists,and you
should contact customer services ASAP. We will attempt to arrange a new delivery
schedule ASAP after the originally failed attempt.
Refund Policy
If you for any reason decide that you do not want any item which has been
delivered then, provided that it is returned to us in its original and unused
condition including in its original packaging, within 7 days of delivery, we
will exchange it or offer a refund.
Return postal costs on all unwanted goods is the buyers
responsibility ,this does not apply for damaged goods.

We recommend you use a tracked delivery method, as we cannot
be held liable for missing or damaged goods (we can arrange the collection at
cost,please contact).
This guarantee is in addition to and does not affect your
statutory rights. If you post the item to us, we will endeavour to send you a
replacement or refund your payment, within 14 days
Price
The price is in GBP,£,Sterling and is agreed at the time the
contract is made and includes Value Added Tax and other taxes, duties and
Delivery to mainland UK(Scottish Highlands, Offshore Islands and All Other Parts
Of The UK Are Subject To A Paid Subsidy).
Payment Terms
A. Full payment of goods is expected at the time of entering
this agreement or before delivery.
B. Payment for goods to be delivered within the United
Kingdom MUST be by cleared funds
prior to delivery, or delivery will be delayed until payment is received.
Acceptable methods of payment are cash, bank transfer, bankers draft, cheque,
credit card and debit card, but please note that sufficient time must be
allowed for bankers drafts and cheques to clear prior to delivery.
C. If you wish goods to be delivered outside the United
Kingdom, please discuss payment with customer services. Payment must be in full
and in GBP Sterling.
D. To protect your security and to prevent credit card fraud
where possible, we reserve the right for proof of ID on all purchases.
E. If the delivery and billing address are different, or to
enable us to carry out necessary security checks, we reserve the right to be
provided with two proofs of address, which would ideally come from utility
bills e.g. council tax, gas, electric, etc. We can only accept originals - NOT
copies.
Ownership
The goods remain our (Portobello Home And Garden) property
until full payment has been received by us at which time ownership passes to
you.
You will be
responsible for the care of the goods once you have received delivery of them(ownership).
Delivery Policy
It is our policy to deliver goods to you as quickly as we
can. In return we expect you to assist us to arrange the delivery date promptly
once you are advised that the goods are available. We would normally expect you
to confirm with us a mutually acceptable date for delivery within three business days of you being notified
that the goods are ready for dispatch.
Data Protection
Please note that the provision by you of personal data on
this form infers your consent to the transfer of details relating to your
purchase including,but not limited to
your name address and telephone number to the warranty dispatch and between any
other authorised party involved in processing any subsequent claim that you may
make. We will also be entitled to use personal data held by us for accounting,
statistical or marketing purposes or other reasonable purposes connected with
our business.
Credit Card Security
All Phone Orders credit card numbers are destroyed immediately
after order is placed to ensure the your card security
Products/Product Information
The information contained in our website is intended for
guidance only and products and the listed prices described in it are subject to
change without notice.
We try to make sure
that all information on the Website, including descriptions of our Goods, and
listed prices, are accurate and correct at all times.
We aim to check all entries to the website, but mistakes do happen. We aim to resolve all
information errors on the Website ASAP, and if we reasonably think that such an
error has affected the purchase of goods we will try to let you know.
We will not be liable to you for any errors on the Website.
We reserve the right to withdraw any offers without prior
notice.

We cannot guarantee that our website will be compatible with
all hardware and software which may be used by all web visitors. If you
experience any difficulty using our website, please contact customer services.
Severability
Each of these terms is severable. Meaning that if one term
is not considered to be legally enforceable, that will not necessarily mean
that the other terms are not enforceable.
Limitations
Issues that may arise that we will not pay for:-
A. Reasonable wear and tear or damage caused by negligence
and/or improper use (unless it is our suppliers' or our own negligence or
improper use).
B. Damage that occurs as result of repairs or alterations
made without our approval.
C. Loss or damage relating to your business.
